Everest Lure – Terms & Conditions

1. Introduction

Welcome to Everest Lure (“Everest Lure,” “we,” “our,” or “us”). These Terms and Conditions (the “Terms”) govern your access to and use of our website located at everestlure.com and any associated sub‑domains hosted on Shopify (collectively, the “Site”), as well as your purchase of any fishing lures or related products (the “Products”) offered through the Site. By accessing or using the Site, or by purchasing Products from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Account Registration & Security

You may browse the Site without creating an account, but certain features (such as order history) require registration. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activities that occur under your account.

3. Orders & Acceptance

All orders placed through the Site are offers to purchase the Products listed in your cart. Receipt of an order confirmation does not constitute our acceptance. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in product or pricing information, or suspected fraud.

4. Pricing & Payment

Prices are displayed in U.S. Dollars unless stated otherwise. We reserve the right to change prices at any time. The price charged will be the price displayed at checkout plus any applicable sales tax and shipping charges. Payments are processed securely through Shopify Payments and other third‑party processors. By providing payment information, you represent that you are authorized to use the designated payment method.

5. Shipping & Delivery

We ship to the destinations and via the methods listed on the Shipping Policy page. Shipping times are estimates and not guaranteed. Title and risk of loss for Products pass to you upon our delivery to the carrier.

6. Returns & Refunds

If you are not satisfied with your purchase, you may initiate a return within 7 days of delivery, subject to our Return Policy. Returned items must be unused, in original packaging, and accompanied by proof of purchase. Refunds are issued to the original payment method after inspection of the returned Product.

7. Product Descriptions & Disclaimer

We strive to describe and photograph Products accurately; however, slight variations (e.g., color or pattern) may occur. All specifications and descriptions are provided “as is.” Fishing involves inherent risks, including sharp hooks. You acknowledge and assume all risks associated with the use of our Products.

8. Intellectual Property

All content on the Site—including text, graphics, logos, images, and code—is the property of Everest Lure or its licensors and is protected by U.S. and international intellectual‑property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our express written permission.

9. User Content & Reviews

You may submit product reviews, photos, or other content (“User Content”). By posting User Content, you grant Everest Lures a non‑exclusive, royalty‑free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, and display it worldwide in any media. You represent that your User Content does not infringe any third‑party rights and is not unlawful, obscene, or otherwise objectionable.

10. Prohibited Conduct

You agree not to:

  • Use the Site for any illegal purpose or in violation of any law.

  • Transmit viruses, malware, or other harmful code.

  • Interfere with or disrupt the Site’s operation.

  • Attempt to gain unauthorized access to any systems or networks connected to the Site.

11. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEREST LURES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEREST LURE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTly, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) THAT GAVE RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Everest Lure, its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site, violation of these Terms, or infringement of any third‑party rights.

14. Governing Law & Dispute Resolution

These Terms and any dispute arising from them are governed by the laws of the State of Missouri, USA, without regard to its conflict‑of‑law principles. Any legal action must be brought in the state or federal courts located in Missouri, and you consent to their exclusive jurisdiction.

15. Changes to Terms

We may modify these Terms at any time by posting the revised version on the Site and updating the “Effective Date” above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held unlawful or unenforceable, that provision will be deemed severed and will not affect the validity of the remaining provisions.
